Newell City Commission votes to remove member

NEWELL, SD – The Newell City Commission has voted to seek the removal of Commissioner Allen Youngberg from office. 

Youngberg, 67,  was indicted by a grand jury in Butte County November  14, 2017. He was charged with stalking and sexual contact without consent involving a home aid. Both charges are Class 1 misdemeanor punishable by up to one year in county jail and/or a $2,000 fine.

A special commission meeting was held January 16, 2018 where following an executive session,  the commission sought the assistance of Butte County State’s Attorney Cassie Wendt to remove Youngberg from office. 

Later, during a regular city commission meeting on February 12 2018,  Youngberg questioned the minutes of the January 16, 2018 special meeting (he was not in attendance) requesting clarification.

State statutes outline the removal of a city commissioner from office.  Which of those statutes applies to this case have not been cited by the commission or the state’s attorney’s office.

Spearfish attorney Tim Barnaud represents Youngberg in the criminal matter.  It is not known if he has retained other counsel over the actions taken by the city commission to remove him from office.

Youngberg pleaded not guilty to the criminal charges in December of last year.

Since 2010, three other people have filed for permanent protection orders against Youngberg in Butte County. All the cases were dismissed, according to court records, because of the petitioners’ failure to provide sufficient evidence.
