Sturgis asks to intervene in Buffalo Chip case

STURGIS, S.D. - Now that the State of South Dakota has decided to challenge the legality of the incorporation of the Buffalo Chip Campground, Sturgis wants back in to argue their side of the case.

Sturgis on Thursday asked the state Supreme Court if it could intervene in the state's effort to block the Chip from continuing to operate as a city.

A central contention in the filing is that the 2015 vote to incorporate the town of Buffalo Chip involved "fraudulent voter registrations."

The Buffalo Chip Campground became its own town in 2015 but the status was quickly challenged in court by area residents and the City of Sturgis. The South Dakota League of Municipalities later joined the case.

In 2016 a judge ruled in favor of the plaintiffs, but, on appeal, the Supreme Court ruled this year that the Chip can remain a municipality as only the state can challenge its status as a town. In March the state brought that action. And now Sturgis has asked to join the case.

The Supreme Court will consider the city's request. Lawyers for the Buffalo Chip say they plan to file a response as well to the city's request.
