Supreme Court overturns ruling barring Buffalo Chip from becoming municipality

STURGIS, S.D. - The South Dakota Supreme Court has overturned a judge's ruling that the Buffalo Chip Campground couldn't be its own town.

The high court overturned a circuit court that had found the Meade County Board of Commissioners had erred when it allowed the Sturgis Motorcycle Rally campground's municipal incorporation procedures to go forward.

The judges unanimously ruled that Jane Murphy, Garry Lippold and the City of Sturgis had no standing to appeal the lower court's ruling and that only the state could file such an appeal.

The campground-turned-city has faced opposition from nearby Sturgis and others.

Campground attorney Kent Hagg has said in the past he believes Sturgis wants to annex Buffalo Chip for sales tax revenue. Sturgis has denied those claims, and has said they were worried abou the Buffalo Chip's encroachment on its municipal airport. 

Buffalo Chip owner Rod Woodruff has said he wanted the incorporation to lure in special businesses that could offer year-round service. Such an announcement has yet to be made.
