PIERRE, S.D. – Although South Dakota state law doesn’t say it, the state Retailers’ Association says sellers of tobacco should heed the federal law banning the sale of tobacco products to those under 21.
The U.S. Food and Drug Administration announced just before Christmas that the new federal minimum age of sale for tobacco products is now 21.
Last week, President Trump signed legislation that raised the federal minimum age for purchase of tobacco products from 18 to 21. Although provisions in the law allow for a rulemaking period, a statement on the FDA website declares the law in immediate effect.”
Although South Dakota state law has not been updated to align with the federal law, the state’s retail association announced today that retailers should heed FDA guidance.
