Swallow - Sentencing

Woman who accepted Alford Plea sentenced to prison for killing of her nephew

- September 9, 2019

RAPID CITY, S.D. – A Rapid City woman was sentenced to 10 years in prison Monday for the stabbing death of her nephew.

Lorraine Swallow was charged in the death of 28-year-old Tyrell Bull Bear.

Swallow has maintained throughout court proceedings that she stabbed Bull Bear out of self-defense and that his impaled himself after lunging at her.

But, Seventh  Circuit Judge Matt Brown has said he hadn’t heard Swallow accept responsibility for stabbing Bull Bear. He described the case as a “somber tragedy” due to the loss of life and the family connections involved.

The sentence follows Swallow accepting an Alford plea for the December 2018 death. An Alford plea is when a defendant pleads guilty but at the same time doesn’t admit to committing the crime.

Swallow was tried in May on a charge of second degree murder. When the jury was unable to reach a verdict the state filed to try her again on the same charge.

Swallow will receive credit for the 275 days in jail she has already served.
