Some defendants in the case that has rocked the American Legion Baseball Program in South Dakota, are trying to have their cases moved to juvenile court.

Baseball players accused of rape make court appearance

RAPID CITY, S.D. – Members of a Mitchell Legion Baseball team under investigation for alleged rape, appeared in a Pennington County courtroom Monday, Feb. 5.

Six Mitchell baseball players are charged with rape in adult court.

It happened shortly after a game in Pennington County, which is where the alleged crimes took place.

The case had all six teenagers being tried as adults. However, three of the defendants who were under 18 at the time of the incident asked to have their cases moved to juvenile court; a future hearing will be held for that request.

As for Hudson Haley, Landon Waddell and Lincoln Bates – all of whom were over the age of 18 at the time – they will still be tried as adults.

There will be a status update for this case on the same date as the transfer hearing for the other three suspects.

The defendants will need to have their expert witness list into the judge 90 days before this hearing, with the state needing to review by 60 days to the hearing date.

The next hearing is set for July 1-3, 2024.

Coach Luke Norden and Mitchell Baseball Association Board president Jeremy Borgan also face charges in connection to this case.
