City of Sturgis moves to have lawsuit filed by municipal candidates dismissed

STURGIS, S.D. – The city of Sturgis has moved to dismiss a lawsuit filed by three candidates running for public office.

Tammy Bohn, running for mayor, and Justin Bohn and Brenda Vasknetz, running for council, filed a suit after a judge ruled against their previous lawsuit that sought an election to get rid of the city manager.

The city says the court lacks jurisdiction of subject matter in the case.

The case filed by the Bohn’s and  Vasknetz has two counts. It asks the court to determine whether the 2007 election was legal when it set up the city manager. It also has a second count that forces current city manager Daniel Ainslie pay back his salary, dating back to when he was hired in 2011. It does not mention the city’s first city manager David Boone.
