HOA gun bill passes through committee Monday

PIERRE, S.D. (SDBA) — A bill allowing residents of a homeowners’ association to carry weapons in any part of the HOA continues its quick trek through the legislature this morning (Monday).
SB39 would prevent an HOA board from banning firearms in the common areas of a facility, such as the sidewalk. Residents can keep guns in their homes.
It passed the House Commerce and Energy Committee 11 to 1. Previously, the measure passed the Senate 30 to 3.
According to investopia.com, a HOA is an organization in a subdivision, planned community, or condominium building that makes and enforces rules for the properties and residents.
Proponents said HOAs should not be able to ban firearms, since the legislature has preempted local governments from enacting gun laws.
“The legislature is the sole determiner of gun laws,” said NRA lobbyist Brian Gosch (gahsh).
Proponents also said the measure would impact 40,000 South Dakotans in 17,000 HOA homes.
No one testified against the bill.
It now goes to the House of Representatives for consideration.
