STURGIS, S.D. – At a status hearing Friday, a judge set May 20 as the date to begin hearing the many motions filed in a lawsuit against the city of Sturgis.
Tammy and Justin Bohn and Brenda Vasknetz filed a lawsuit in March alleging the current city manager form of government is invalid.
It follows a judge’s ruling in February that struck down the trio’s first lawsuit seeking an election to elminate the city manager’s position.
The current lawsuit asks a judge to nullify the 2007 election that set up the city manager’s office, and if it was unlawfully created, asks for current city manager Daniel Ainslie to pay back his salary since he first started in 2011.
City officials say the lawsuit is specfically targeted at Ainslie, because it doesn’t mention the city’s first city manager David Boone.
The city has asked Judge Kevin Krull to dismiss the case, saying the court lacks jurisdiction. That motion will be heard at the May hearing.
