RAPID CITY, S.D. – A man who prosecutors say was driving while intoxicated and caused an accident that killed one person has entered a change of plea during a court appearance Monday.
Nicholas Herman, 20, of Custer, plead guilty to vehicular homicide for his role in an accident on Rapid City’s north side.
Herman was driving a car that rolled over in the early morning hours of December 31, 2022 on East North Street. The accident claimed the life of one person and seriously injured two others.
Prosecutors say Herman had a blood alcohol content of .143, more than double the legal limit of 0.08.
In return for his guilty plea, prosecutors agreed to drop other charges against Herman.
Sentencing has been set for April 24.
