Rapid City Council tables initial ordinance; passes new one for masking up

RAPID CITY, S.D. – Instead of passing second reading of their initial ordinance concerning a possible city mask mandate, the Rapid City Council last night passed first reading of a new, updated ordinance.

The additions to the new mask mandate ordinance places the burden of enforcement on businesses rather than law enforcement. Ordinance 6454 penalizes citizens through an administrative process, not a criminal process. The City will notify a business they’ve violated the rule, investigate and penalize accordingly. The City Code Enforcement will report the violation. According to the ordinance, a business could be fined if continued violations occur.

Also added to the new ordinance, an “opt out” clause for businesses. If they do opt-out, they will need to display a sign that indicates they are not participating with the ordinance.

Removed from the ordinance was the addition of ‘houses of worship,’ or churches as a public place where a mask would be required. Several members of the public, as well as several council members, were concerned and expressed disapproval.

Council members tabled their initial ordinance concerning a mask mandate as well as an emergency resolution that dealt with an encouragement of wearing masks within the city.

Second reading of the new ordinance will take place next Monday night.
