RAPID CITY, S.D. – A Spearfish man is appealing his conviction for killing his wife to the South Dakota Supreme Court.
Dreau Rogers was convicted earlier this year for killing his wife, Destiny, in their home.
Tuesday before the state Supreme Court, Rogers appealed this sentence, citing multiple legal issues resulting in his guilty verdict.
Rogers claims any reasonable person would have acquitted him given the evidence his defense claims to have proved. He says that evidence included photos showing police using “dirty gloves” to handle the gun used in the incident.
Rogers says police also gave the other suspect, Donavan Derrek, his phone back, which was key evidence in determining Derrek’s whereabouts during the incident. Rogers says during the trial it was proven both Rogers and Derrek had gunshot residue on them which could have indicated they were both on scene.
The Supreme Court will take the testimony under advisement and issue a ruling later.
