PIERRE, S.D. – South Dakota Attorney General Marty Jackley announces that a Spearfish man was arrested Wednesday on one count of Possession of Child Pornography.
James Frank, 37, was arrested following an investigation of a cyber tip received by the Internet Crimes Against Children (ICAC) Task Force, which is part of the Attorney General’s Office.
Frank’s address, listed on the court documents, matches the address listed on business filings for an unlicensed in-home child care center run by his wife.
According to the affidavit filed in the case, the South Dakota Internet Crimes Against Children (ICAC) task force received a tip from the National Centers for Missing and Exploited Children (NCMEC) in December of 2024. The affidavit states that the IP address and phone number of the suspect traced back to Frank.
ICAC is continuing its investigation. The defendant is presumed innocent under the U.S. Constitution.
