PIERRE, S.D. – A state investigation found a police officer was justified in shooting a man during a foot pursuit through a Sioux Falls neighborhood.
The investigation stems from an incident on July 13. Police said the suspect, later identified as Sean Henry David Kilbourn, stole a handgun from a vehicle in a garage. Kilbourn then threatened the homeowner with it, then ran away.
Police later found Kilbourn nearby, and a foot chase ensued. An officer soon found Kilbourn lying on the ground next to a shed. According to DCI investigators, Kilbourn pointed a gun at the officer.
The officer shot and injured Kilbourn. His wounds were not life-threatening. Police arrested him after he was released from the hospital.
Test results indicated drugs, including methamphetamine ,were found in Kilbourn’s system. A baggie containing fentanyl also was located at the scene.
Attorney General Marty Jackley’s office issued a statement Thursday saying the officer was justified in using lethal force.
