PIEDMONT, S.D. – A heated debate over use of a private road is headed to court in Meade County.
Homer Smith Road is located between Tilford and Piedmont and was recently barricaded by homeowners Ralph and Carleen Greslin, who say the road is private property and Meade County Commissioners agree.
When the barricade was knocked down, the Greslin’s reported it to the Meade County and the Greslin’s want it investigated as trespassing and vandalism.
A group of homeowners who live just beyond the Greslin on Homer Smith Road have filed a lawsuit claiming that by their mere use of the road for many years, they have established a prescriptive easement and may use the road.
The Greslins’ disagree and say they have tried to negotiate with the homeowners who use the road to access their properties, but have been rejected.
Now, the issue is headed to court. On the plaintiffs’ side are landowners who are affected by the road’s closure. Listed as defendants are the Greslin’s, Paul and Kay Holst and Meade County.
