RAPID CITY, S.D. – The man involved in a shootout with law enforcement at last year’s Sturgis Rally appeared in court Wednesday to address part two information, which would enhance penalties for charges if the court establishes him as a habitual offender, regarding his case.
Wyatt Fluty, 28, had an arraignment in September 2023, but the prosecution had not filed for part two enhancements to be considered. He is accused of six different charges with the primary offenses being attempted first-degree murder of a police officer and attempted first-degree murder.
Wednesday, an additional arraignment was held to discuss what Fluty’s sentence would be if the courts considered part two. The defense objected to the inclusion of part two enhancements but was overruled.

As part of this process, Fluty pleaded not guilty to all six charges in his case as well as denying the part two enhancements.
Additionally, Fluty’s trial was set for the weeks of June 17 and June 24.
